(Patria) - Governor of the Central Bank of BiH Jasmina Selimović has been holding two public offices since December 2023, which is contrary to the Law on Prevention of Conflict of Interest in Institutions at the Level of Bosnia and Herzegovina and the Law on Prevention and Suppression of Corruption in Sarajevo Canton.
These days, the focus is on cantonal representative Faruk Kapidžić, who is also a member of the Commission to Preserve National Monuments of BiH, and the Office for the Fight against Corruption has determined a conflict of interest because he holds two public offices. He has been given a 30-day deadline to leave one of these functions. However, while the debate continues on whether he is truly in a conflict of interest, there are other similar cases where no action has yet been taken.
Such a case is precisely that of Jasmina Selimović. She has been the Chair of the Steering Board of the Health Insurance Fund of Sarajevo Canton even before the Presidency of BiH appointed the new composition of the Governing Board of the Central Bank of BiH in December 2023, which consists of Prof. Dr. Jasmina Selimović, Prof. Dr. Mirza Kršo, Prof. Dr. Danijela Martinović, Prof. Dr. Darko Tomaš, and Prof. Dr. Radomir Božić.
Since January 2024, Selimović has been the Governor of the Central Bank of BiH, while remaining the Chair of the Steering Board of the Health Insurance Fund of Sarajevo Canton, where she receives a monetary compensation. We will write about the Steering Board of the Health Insurance Fund of Sarajevo Canton and decision-making in this institution, whose budget exceeds 600 million KM, on another occasion, but in Selimović's case, the law is clear.
The state Law on Conflict of Interest clearly stipulates which functions are considered public:
"A holder of a public function in institutions at the level of Bosnia and Herzegovina" (hereinafter: holder of a public function) is an elected or appointed person, a manager in an institution at the level of Bosnia and Herzegovina, a manager in a legal entity established by an institution at the level of Bosnia and Herzegovina, a manager in a legal entity that, in accordance with the law of Bosnia and Herzegovina, exercises public authorities or activities of public interest, as well as a manager or person whose election or appointment is approved by the Parliamentary Assembly of Bosnia and Herzegovina, the Presidency of Bosnia and Herzegovina, and the Council of Ministers of Bosnia and Herzegovina, a manager in an institution at the level of Bosnia and Herzegovina who has the status of a civil servant secretary with a special task, as well as the head of cabinet, advisor to an elected or appointed person, manager in an institution at the level of Bosnia and Herzegovina, manager in a legal entity established by an institution at the level of Bosnia and Herzegovina, manager in a legal entity that, in accordance with the law of Bosnia and Herzegovina, exercises public authorities or activities of public interest, as well as a manager or person whose election or appointment is approved by the Parliamentary Assembly of Bosnia and Herzegovina, the Presidency of Bosnia and Herzegovina, and the Council of Ministers of Bosnia and Herzegovina," states Article 4 of this law.
Selimović at the helm of the Steering Board of the Health Insurance Fund of Sarajevo Canton
Given that Selimović was appointed to the Governing Board by a decision of the Presidency, it is clear that this law also applies to her. According to the cantonal law, membership in the steering or supervisory board of public institutions is also considered a public function.
On the other hand, we will also recall the case of Mirza Kršo, who is also a member of the Governing Board of the Central Bank of BiH, and who was previously an advisor to Denis Bećirović in the Presidency of BiH. While Kršo left his position as advisor in the Presidency of BiH, Selimović has been holding two public offices throughout this entire year. Incidentally, both Selimović and Kršo are proposals of Denis Bećirović.
If she already lacked the moral need to leave the position of Chair of the Steering Board of the Health Insurance Fund of Sarajevo Canton, then the competent institutions should have already reacted in this case, especially after the adoption of the law at the state level in March this year. The salary of the Governor of the Central Bank of BiH amounts to more than 8,000 KM, while as Chair of the Steering Board of the Health Insurance Fund of Sarajevo Canton, according to the register of appointed persons, she has a compensation of 400 KM. On the website of the Health Insurance Fund of Sarajevo Canton, announcements from held sessions of the Steering Board chaired by Selimović can also be found, meaning she actively works in this position as well.
However, Selimović obviously belongs to persons close to the ruling parties, unlike Kapidžić, and accordingly, legal provisions are selectively applied only to some holders of public functions.
