It is still not precisely clear whether Sevlid Hurtić, Minister of Human Rights and Refugees of BiH, will sign the travel order for Monika Mijić, acting agent in the Office of the Council of Ministers' Agent before the European Court of Human Rights in Strasbourg, where a hearing is scheduled for November 20 in the case "Slaven Kovačević v. BiH", but it is becoming increasingly clear that the HDZ is most interested in this happening.
Davor Bunoza (HDZ), the Minister of Justice of BiH, is particularly active in lobbying, and according to Hurtić, concluded at a Council of Ministers session that it is Hurtić's obligation to sign the travel order for them.
The reason why Bunoza is so keen on this travel order being signed is evident from a part of the document we are publishing. Namely, according to the official announcement sent to Strasbourg, besides Monika Mijić as the agent (which she is not), Sandra Malešić, advisor, Davor Bunoza, Minister of Justice of BiH, as well as entity justice ministers Vedran Škobić and Miloš Bukejlović are supposed to travel!?
None of them would be able to travel if Hurtić refuses to sign the travel order, as they are listed as 'advisors' to Mijić.
It is now more than clear that on one side we have an ordinary citizen seeking active voting rights for all citizens, and on the other, the HDZ-SNSD machinery that is trying with all its might to overturn such a verdict.
We remind you that Monika Mijić's seventh term as acting agent of the Council of Ministers before the European Court of Human Rights has also expired.
It is also known that according to the Law on Administration, this is limited to a maximum of two terms.
Although it is clear to everyone, and the Office for Legislation has undoubtedly confirmed, it is not possible to replace an act of higher legal force (decision) with an act of lower legal force (conclusion), as this would be illegal, which is precisely what the Council of Ministers did at its 56th session on July 18, 2024, thus attempting to illegally extend the expired mandates of acting agents of the Council of Ministers before the European Court of Human Rights.
This also raises the question of whether the part of the government calling itself the Troika is aware of these legal provisions and procedures, as it is evident that they, or at least part of them, voted for such a conclusion, which is an act of lower legal force, attempting to replace a "decision" as an act of higher legal force.
Now another question arises – how and in what way are they convincing Hurtić that he can sign the travel order for the agents to travel to Strasbourg, as by doing so he would open the door for new criminal charges against him. They are literally inciting him to commit a criminal offense, all so that Mijić and her team can get to Strasbourg.
We remind you that it was announced today that the High Representative Christian Schmidt will not address the Grand Chamber of the European Court of Human Rights (ECHR) in Strasbourg in the case "Slaven Kovačević vs. BiH", but lawyers from Great Britain hired by Schmidt will. They will also work to overturn the verdict.
And this is about a historic decision of the ECHR. According to it, Bosnia and Herzegovina (BiH) should be a single electoral unit, and citizens can vote for a candidate for the Presidency of BiH regardless of which nation they belong to and in which entity they live. Delegates to the House of Peoples of the BiH Parliamentary Assembly would be elected from among the members of the nations from the territory of the entire country, not just its individual parts.
