Hadžidedić for NAP: We are obliged to return to the Constitution of the RBiH because Dayton no longer functions

(Patria) - The question is whether Bosnia and Herzegovina will survive until the General Elections in 2026, warns political scientist and university professor Zlatko Hadžidedić in an interview with the Patria News Agency (NAP).

- I very seriously said before the 2022 elections that people should pay attention to who they vote for, because it could easily happen that the state falls apart before the next ones and that those would be the last elections.

They are here to dismantle the state

At the time, many did not take me seriously. They thought, sort of, that I was exaggerating. And here we are, the situation is such that it is very questionable whether this state in its current condition will even survive until 2026 - says Hadžidedić.

According to him, the people currently in power do not want Bosnia and Herzegovina to survive, whether it is Milorad Dodik, Dragan Čović, Nermin Nikšić, or Elmedin Konaković.

- They are all here to dismantle the state. They came to do that job and they are doing it very well. It is very questionable whether the state can survive with them in power and with this story about constituent peoples and the original Dayton.

There is no possibility to block everything the way they do, and yet they still block it. With these people in power, this state has no future - emphasizes Hadžidedić.

He states that the same applies to "those from the SDA who were in power for 30 years and brought the state to this point and also participated in all those lies together with Dodik, Čović, and others."

- A way out of the current situation must be found, but I, first of all, do not see the political will. There is a will for some kind of tug-of-war to, well, prove that someone opposed Dodik or Čović.

But overall, I do not see anyone coming out with the right point. And the right point is that both Dodik and Čović are actually dealing with completely false categories that do not exist anywhere in Dayton. And everything they have started was initiated based on pure lies.

This whole story about some original Dayton is a pure lie. There is no original Dayton, there is only the original Dayton that they have never even read. Or if they have read it, they have interpreted it completely backwards.

But the problem is that in our environment, no one reads. There have been many such cases - a cliché like that of legitimate representation or constituent peoples is imposed.

Constituent peoples do not exist in the Constitution, that is a complete fabrication. There are constituent peoples (in English constituent peoples), which means - the peoples that make up Bosnia and Herzegovina and others together with citizens.

That is not a term that places anyone hierarchically, that there are some constituent peoples, while others are non-constituent. Constituent would mean that they are the ones who create the Constitution, the entire constitutional order, but that is not the case.

I am sorry, but, well, there are no constituent peoples. The Constitution was not created by any constituent peoples, it was created by Richard Holbrooke's team - so, Americans.

And then again, who signed that Dayton - again, it was not signed by any representatives of the so-called constituent peoples, but by Franjo Tuđman, Slobodan Milošević, and Alija Izetbegović - on behalf of BiH.

So, no one signed on behalf of the peoples, let alone created a Constitution in the name of some phantom constituent peoples. All of that is a lie - states Hadžidedić.

Dodik's and Čović's lies

He emphasizes that for years we have had to deal with Dodik's and Čović's lies, and no one tells them - come on, stop people, those are lies, there are no constituent peoples nor legitimate representation.

- This whole story of Dodik's about the original Dayton, about returning to the original Dayton, is also a lie. They are bothered by the fact that some amendment was possibly introduced, and they all signed it from the RS - at every moment when decisions were made, whether in Parliament, or whether it was imposed by the High Representative, and there were several such decisions.

Subsequently, the Parliament adopted them and everyone from the Republika Srpska voted for them. Therefore, it cannot be like that - you conclude a contract and then you would now run away from it.

Or what you like - you would take it. You like the Republika Srpska, but you do not like the High Representative. Well, I am sorry, the High Representative is part of Dayton just like the RS.

If you are going to dismantle Dayton and demand that there be no High Representative, you are thereby renouncing the entire international agreement - it is not a smorgasbord - you take what you like and discard what you do not like.

And even less can it exist with these invented categories, with lies like constituent peoples. And all these years we have been wallowing in that mud that consists of lies.

Well, something is not right there. Then it is not right with those who should be defending Bosnia and Herzegovina, whether it is some Bakir Izetbegović, Nermin Nikšić, or Dino Konaković.

None of them are right. They are not defending Bosnia and Herzegovina, but are complicit in those lies, because all these years they have accepted all those false categories - underscores Hadžidedić.

And what should we citizens say then, continues our interlocutor, we can only ask all of them to step down, because they have lied to us enough.

- They have all lied to us enough, so it would be right for them to step down. But that will must also exist among the citizens, and I do not see it for now. However, it should arise among the citizens, but first someone needs to explain to them that all of this is lies.

We are not spinning in any vicious circle, but in a circle of lies, and that finally needs to be said. The problem is that we have accepted that in our civil rights and possibilities we are limited by people who were brought here to destroy the state - says Hadžidedić.

He notes that it is quite realistic to return to the Constitution of the Republic of Bosnia and Herzegovina, and that the law requires exactly that.

The 1995 Law

- Dayton was not adopted in Parliament at all. However, it was given a sort of legal status by the Constitutional Law of December 12, 1995.

In the first article of that law, it says that the Republic of Bosnia and Herzegovina retains the right to change its constitutional order through an international agreement, although that is a very strange provision.

And in the next paragraph of that same article, it says: "If the Dayton Constitution is not applied, the Republic of Bosnia and Herzegovina returns to its Constitution." Therefore, we have that legal obligation.


The Constitutional Law of 1995

Here, Dayton is not functioning, Schmidt and Dodik have destroyed it. They are making it completely non-functional by introducing a bunch of false categories.

Dayton has completely collapsed, it no longer functions in any way. And we are obliged by that law under which Dayton was even legalized in the parliament of the Republic of BiH.

There, that same article tells us both things - that we can change the constitutional order through an international agreement, but also that if it does not function - we return to the Constitution of the Republic of BiH.

And if we cannot do that, do you know what that is? That means a coup has been carried out here. If we cannot apply any law, then that is a state coup. But then we have a dictatorship of a few arrogant primitives who still think they can convince us with their lies that we are not under a dictatorship, but that everything is regular - says Professor Hadžidedić.

He emphasizes that it can be established that the Dayton Constitution is not functioning and that we are then obliged to apply that law, and that there is no need for any vote in Parliament.

- If that international agreement does not function and if the constitutional order established by that agreement does not function, we are obliged to return to the Constitution of the RBiH.

We have an obligation, there is no voting. And if we cannot apply that law from 1995, that means we have no legal order and we are in a situation where someone has illegally seized power.

There, I have listed for you how many false categories exist that are being dealt with. And now we would also have to vote on all of that. Let us understand that we all live in a bubble where it seems to us that this is reality, but it has nothing to do with reality.

But they have managed to deceive us, over all these years, repeating the same lies, non-stop. There is no voting on something that has already been voted on. That law is valid, and by that law, Dayton itself is valid.

We are obliged to return to the Constitution of the Republic of Bosnia and Herzegovina, because this is not functioning. Why has no one thought of that? Well, because they have managed over all these years to convince us that we are completely mentally backward and that we do not notice the reality around us.

Let everyone take and read that Constitutional Law of December 12, 1995, on the internet. Let them read the first article, they do not need to read anything further. Everything is written in it. And we are simply obliged to respect that - concluded Hadžidedić in an interview with Patrija.
