Anniversary of Nenad Nešić's arrest, the BiH Prosecutor's Office has not yet filed an indictment in the 'Tunnel 2' case

(Patria) - Exactly one year ago, in the operation of the BiH Prosecutor's Office "Tunnel 2", the then Minister of Security of BiH Nenad Nešić and several other persons were arrested. Also arrested with him were Mirko Pandurević, General Director of "Romanijaputevi", Srđan Mijatović, Executive Director for Economic and Financial Affairs at "Putevi Republike Srpske", Mladen Lučić, as director of the company "Legend" which did business with "Putevi RS-a", and Milan Dakić.

Nešić is suspected of the criminal offense of associating for the purpose of committing criminal acts under Article 249 of the Criminal Code of BiH, abuse of official position or authority (Article 315 of the Criminal Code of RS) and accepting bribes (Article 319 of the Criminal Code of RS), as well as Lučić, while Dakić is suspected of abuse of official position and accepting bribes.

After one year, the BiH Prosecutor's Office, i.e., the prosecuting prosecutor Bojana Jolović, has not yet filed an indictment in this case.

Nenad Nešić spent almost five months in custody, and in January he resigned from the position of Minister of Security of BiH.

The Court of Bosnia and Herzegovina in October this year, in the case of Esad Avdić and others, issued a decision accepting the defense proposal of the suspect from September 29, with which the BiH Prosecutor's Office agreed, in a way that regarding the suspect Nenad Nešić, the offered bail in the amount of 1,370,000 KM is accepted, and the prohibition measures are lifted.

"The travel ban and the measure of mandatory periodic reporting to the state authority have been lifted, while the control of the necessity of the further duration of the remaining imposed measure of prohibition of meeting with certain persons, which still exists for the suspect Nenad Nešić, will be carried out within the period determined by the last decision on the control of prohibition measures of the Court of BiH," the Court of BiH announced.

The suspect was specifically warned that the accepted bail will be revoked and the suspect will be ordered into custody if he does not respond to the summons of the Court or the Prosecutor's Office and does not justify his absence, or if some other legal basis for custody arises against him.

"The imposed measure of ensuring presence may last until the final conclusion of the criminal proceedings or until a different decision of the Court," the statement adds.

At the hearing held on December 28, 2024, prosecutor Jolović stated that according to the testimony of suspect Mirko Pandurević, Nešić was given 250,000 KM annually, and over four years that amounts to one million KM.

Incidentally, as the Prosecutor's Office explained in the proposal for ordering custody, the money was extracted from the public company Putevi RS, whose director was Nešić, in such a way that Pandurević, director of Romanijaputevi, received a job for road maintenance.

The prosecutor claims, and this was also shown by special investigative actions of telecommunications surveillance, that Nešić's accomplice was Mladen Lučić, who, it is alleged, received a bribe in the amount of 185,000 KM.

In one of Pandurević's conversations that he conducted in his office, he says:

“Nešić organized everything through Lučić Legend. It's my job to pay, and they further arrange among themselves,” prosecutor Jolović read.

Jolović then announced that more than 20 witnesses would be examined, as well as responsible persons in Putevi RS, where a large number of persons would be covered. However, after one year, there is still no indictment in this case, nor is it known who will ultimately be covered by the indictment.
