High Judicial and Prosecutorial Council Responds to Kojović: Information Requested on Deleting Milorad Dodik from Court Register to be Forwarded to Disciplinary Prosecutor's Office

(Patria) - The Basic Court in Banja Luka has twice refused to delete Milorad Dodik as the president of the Alliance of Independent Social Democrats from the court register. The first time in November 2025, at the request of the Central Election Commission, and the second time at the request of the Court of Bosnia and Herzegovina in February 2026.

This means that the final and binding conviction of the Court of Bosnia and Herzegovina of 26.02.2025 was not enforced.

Member of Parliament Predrag Kojović addressed the High Judicial and Prosecutorial Council (VSTV) with a question about what the VSTV will undertake regarding the decisions of the Basic Court in Banja Luka.

"Will the responsibility of the judges who made this decision be examined, and what measures does the VSTV plan to take to ensure the enforcement of final judgments of the Court of Bosnia and Herzegovina?"

He received a response from the President of the VSTV, Sanin Bogunić.

"The Council, in accordance with Article 3 of the Law on the VSTV of BiH, as an independent and autonomous body, has the task of ensuring an independent, impartial, and professional judiciary, as stipulated in Article 17 of this law. It is clear from the relevant provisions of the Law on the VSTV of BiH that the Council is not legally empowered to interfere in the work of judicial institutions regarding specific cases, nor to give instructions and guidelines for the conduct of judicial office holders regarding specific proceedings they are conducting.

In accordance with the above, we inform you that the working bodies of the Council have already considered the highlighted situation, after receiving the first information on the mentioned issue. Namely, after receiving the letter from the CEC dated 13.11.2025, the working bodies of the Council considered the manner of action of the relevant judicial institutions regarding the issue of the legal consequences of the conviction according to the judgment of the Court of BiH of 26.02.2025, and bearing in mind the Council's jurisdiction to ensure the professional work of the judiciary, but without interfering in the work of judicial institutions regarding specific cases.
In order to obtain complete information, before forwarding the received information to the Office of the Disciplinary Prosecutor of the VSTV BiH as the body competent to determine the existence of any punishable omissions in the conduct of judicial office holders, the Council has contacted the relevant judicial institutions, namely the Court of BiH and the Basic Court in Banja Luka, with a request to provide information on the activities undertaken to delete the convicted Milorad Dodik, as the president of the political party SNSD, from the register of political organizations, along with supporting evidence," states the response signed by the President of the VSTV, Sanin Bogunić.
