Nešić presented Dodik's defense, it is now crystal clear why he is not charged with overthrowing the constitutional order!

Milorad Dodik, president of the BiH entity Republika Srpska, will have to appear before the Court of Bosnia and Herzegovina on October 16 at 1 PM, to plead to the charges brought against him by the Prosecutor's Office of Bosnia and Herzegovina.

The BiH Prosecutor's Office, headed by Milanko Kajganić (close to Dodik and SNSD), has indicted Dodik as the primary suspect, and Miloš Lukić, acting director of the Official Gazette of RS, as the secondary suspect, for failing to implement the decisions of the High Representative in BiH.

As is known, the indictment does not charge Dodik with overthrowing the constitutional order of Bosnia and Herzegovina, because the prosecutors did not gather enough courage to charge Dodik with what he could also be convicted of. Kajganić thus hid from foreign mentors (primarily US Ambassador Michael Murphy) by filing an indictment that is essentially not a big problem for Dodik.
And so today, Security Minister Nenad Nešić publicly presented Milorad Dodik's defense strategy on camera!? Nešić waved papers proving the illegitimacy of High Representative Christian Schmidt, and mocked Germany, as well as BiH institutions that allowed Schmidt to enter BiH with long guns!

It is logical that Dodik's defense before the BiH Court will wave the same papers, where they will prove Schmidt's illegitimacy to the court panel, which will ultimately potentially acquit Dodik of guilt!

And it is becoming increasingly clear why Milanko Kajganić decided to form a case against Milorad Dodik for the criminal offense of “failure to implement the decisions of the High Representative,” and not for the criminal offense of “attack on the constitutional order of BiH,” which, after Schmidt's amendments, is much easier to prove than it was in the previous period.

Kajganić did not sign the indictment against Dodik, although he had to, because his position is the first in the state that should defend the rule of law and the constitutional order. However, Kajganić was busy with 'leaking information' and who provided the court decision to the media, which stated the reasons for returning the indictment to the Prosecutor's Office of BiH.

There is no doubt that the initiator of the crisis was the session of the National Assembly of Republika Srpska in June, at which laws concerning the non-publication of OHR decisions and the suspension of the application of decisions of the Constitutional Court of Bosnia and Herzegovina in Republika Srpska were adopted.

The High Representative immediately reacted by annulling these laws using his Bonn powers and ordering amendments to the Criminal Code, but he left Milorad Dodik alive, and thus the space to continue acting in the way we have witnessed in recent days.

While Schmidt accuses Dodik of manipulating the citizens of RS, one could also say that Schmidt is manipulating the citizens of BiH, because his actions, since he took office as High Representative, have exclusively affected the Federation. By annulling the decisions of the NSRS, while at the same time not being recognized as the High Representative in RS, he is deceiving the public in which he wanted to prove that he is indeed working. Now he must show and prove that he exists and works!

And it seems that everyone is making moves that do not resolve the situation, but further complicate it. This is shown by the Prosecutor's Office indictment, as well as Schmidt's earlier decisions, and after all, the reaction of the US Embassy, which welcomed the indictment, even though it is flawed!

The games without borders continue while Dodik looks for an exit ticket, and time is on his side. We will remind you that Kajganić did nothing about the shameful obstruction of movement on the inter-entity line, which is forbidden by Dayton, because it is clear that no one here seems to care about the true rule of law, but rather about games in which political opponents outsmart each other, with the help of the international community.
