Academic Esad Durakovic said last night in the Central News with Senad Hadzifejzovic that the referendum in Republika Srpska on 9 January is actually a game of Covic, Dodik and Izetbegovic.
- I will not exaggerate if I say that, there is one dramatic conflict between the politics and the law. Or, if you will, that is one violent – I use hard words, but I think they are fitting – offensive on the highest legal institution in the country. I deeply believe that, this is not about any new legal arguments due to which the Constitutional Court should re-assess its earlier decision, we are talking about political pressure, which is so big it can be deemed a blackmail, Durakovic said.
He consider it better if the Constitutional Court does not revoke the decision by which marking of 9 January is non constitutional, at the expense of Dodik holding the referendum, then if the Constitutional Court gives in to the pressures and revoke the decision.
At the end of last year, the Constitutional Court of BiH brought a decision on 9 January, otherwise marked in the RS as the day of this BH entity, which said it was not in accordance with the BH Constitution, and that the RS government ought to select some other day to be celebrated as the day of RS. The RS Government refuses to accept the Court decision so they called a referendum for 25 September when the RS citizens will be able to express their opinion.
The International Community has condemned the idea of referendum, including the United States and other world superpowers. They invited Milorad Dodik to give upon the referendum. In his response, Dodik said that the referendum will be called off if the Constitutional Court re-assesses the decision which pronounced the day of RS non constitutional. However, some experts think that would severely damage the credibility of the Court.
